Welcome to Aquillian Tarot.
These Terms and Conditions ("Terms") govern your access to and use of the Aquillian Tarot website, digital platform, subscriptions, app, products and related services (the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services.
These Terms should be read together with our Privacy Policy and any other policies, notices or checkout terms that apply to your use of the Services.
1. Who we are

2. Eligibility
You must be at least 16 years old to use the Services.
By using the Services, you confirm that:
· you are at least 16 years old; and
· you have the legal capacity to enter into these Terms.
3. Services overview
Aquillian Tarot provides:
· tarot card products, including physical and digital products;
· a subscription-based digital platform via our website;
· tarot reading tools and content;
· journalling and reflection features, including text and optional voice-to-text transcript features;
· saved readings and account features; and
· optional automated or AI-assisted features, if enabled.
Features may change, evolve or be removed over time. We may update, improve, suspend or discontinue parts of the Services where reasonably necessary for operational, security, legal or business reasons.
4. Accounts
You are responsible for:
· maintaining the confidentiality of your account login details;
· all activity under your account; and
· ensuring your information is accurate and up to date.
We may suspend or terminate your account if:
· you breach these Terms;
· we detect misuse, fraud or security issues;
· we need to protect the Services, our users or our systems; or
· we are required or permitted to do so by law.
5. Subscriptions, payments and billing
Some Services require a paid subscription or one-off payment.
By purchasing a subscription or product:
· you agree to the pricing, billing cycle and inclusions disclosed at checkout;
· you authorise payment to be taken through our third-party payment providers, such as Squarespace, Stripe or any app store payment provider we use;
· subscriptions may automatically renew unless cancelled before the renewal date; and
· you are responsible for managing your subscription and cancellations through your account settings, checkout provider, app store account or other cancellation method made available to you.
Refunds and consumer rights
Except as required by law, including the Australian Consumer Law, subscription fees and digital product purchases may be non-refundable once charged or accessed.
If you believe there is a fault, major failure or issue with our products or Services, please contact us so we can assess your entitlement to a remedy under applicable consumer protection laws.
6. Physical products, shipping and pre-orders
If you purchase a physical product, such as Aquillian Tarot cards, you are responsible for providing accurate delivery details.
Estimated delivery dates are estimates only and may be affected by third-party carriers, fulfilment providers, customs, public holidays, weather events, supplier delays or other circumstances outside our control.
If we offer pre-orders, any estimated release or shipping date will be provided in good faith but may change. If there is a significant delay, we will provide updates where reasonably practical.
Risk in physical products passes to you when the product is delivered to the address you provided, except where the Australian Consumer Law or another applicable law provides otherwise.
7. Acceptable use
You must not:
· use the Services for unlawful, harmful, abusive, fraudulent or misleading purposes;
· attempt to access systems, accounts or data without authorisation;
· interfere with the functionality, security or availability of the Services;
· copy, scrape, reverse engineer, resell or exploit our content or systems without permission;
· upload malicious code, spam or harmful material;
· use the Services in a way that infringes another person’s rights; or
· misrepresent your identity or your connection with Aquillian Tarot.
8. User content
You may create, save or upload content through the Services, including:
· journal entries;
· tarot readings;
· reflections;
· notes;
· voice-to-text transcripts; and
· other content you choose to provide.
You retain ownership of your content.
You grant us a limited, non-exclusive licence to store, display, process and transmit your content only as reasonably necessary to operate, maintain, improve and provide the Services to you, comply with legal obligations, enforce these Terms and protect the security of the Services.
You are solely responsible for the content you create, save or upload. Please do not enter information you would not want stored digitally, including highly sensitive medical, legal, financial or personal information.
9. Voice-to-text transcript feature
The Services may include an optional voice-to-text feature that allows you to speak and have your words converted into typed journal or reflection text.
This feature creates and stores the transcript text only. Aquillian Tarot does not store your voice recording as an audio file for playback.
We do not use voice recognition, voiceprinting, biometric identification or biometric voice analysis. We do not extract or create voiceprints or voice identifiers from your use of the voice-to-text feature.
You remain responsible for reviewing and editing any transcript before saving it, as automated transcription may contain errors.
10. AI and automated features
Some features may use automated or AI-assisted systems to generate tarot interpretations, journalling prompts, reflection prompts or similar content.
AI-assisted or automated outputs:
· are provided for entertainment, personal reflection and spiritual exploration only;
· may not be accurate, complete, current or reliable;
· may not reflect your personal circumstances; and
· should not be treated as professional advice.
You are responsible for reviewing any output and deciding whether it is useful or appropriate for you.
11. Tarot disclaimer
Tarot readings, interpretations, prompts, app content, website content and related materials provided through Aquillian Tarot:
· are for entertainment, personal reflection and spiritual exploration purposes only;
· do not constitute professional advice, including medical, psychological, financial, legal, business, relationship or crisis advice;
· are not a substitute for qualified professional support; and
· should not be relied on to make major life decisions.
You are solely responsible for your decisions, actions and outcomes.
If you require professional advice, you should consult a qualified professional. If you are in immediate danger or experiencing a crisis, contact emergency services or an appropriate crisis support service in your location.
Aquillian Tarot does not monitor journal entries, saved readings or reflections for emergencies, health concerns, risk of harm or crisis situations.
12. No guarantees
We do not guarantee that:
· the Services will be uninterrupted, secure or error-free;
· all features will always be available;
· outputs, interpretations or prompts will meet your expectations;
· technical issues will never occur; or
· third-party services will always operate as expected.
Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or any other rights that cannot legally be excluded.
13. Intellectual property
All content in the Services, including tarot artwork, branding, logos, designs, card meanings, written content, app features, website content, graphics, layouts and digital materials, is owned or licensed by Aquillian Tarot.
You may use the Services for personal, non-commercial use only unless we give you written permission otherwise.
You must not reproduce, distribute, copy, adapt, modify, publish, sell, license, exploit or use our content for commercial purposes without our prior written permission.
14. Third-party services
Our Services may rely on third-party providers, including:
· Squarespace for website, ecommerce and membership functionality;
· Stripe or other payment processors for payments;
· hosting and infrastructure providers;
· analytics, cookie, performance or technical tools;
· shipping, fulfilment, printing or courier providers;
· email and customer support tools;
· AI service providers, if automated features are enabled; and
· Apple App Store, Google Play or other app distribution platforms, if our app is made available through them.
Third-party services may have their own terms, conditions and privacy practices. We are not responsible for third-party systems, outages, errors, policies or practices, except to the extent required by law.
15. App stores
If you download or access our app through Apple App Store, Google Play or another app store, the relevant app store terms may also apply.
If there is an inconsistency between these Terms and the app store terms, the app store terms may apply to your use of the app store, payments made through that store, refunds managed by that store, and app distribution requirements.
16. Privacy
We handle personal information in accordance with our Privacy Policy.
By using the Services, you acknowledge that we may collect, use, store and disclose personal information as described in our Privacy Policy.
The Privacy Policy explains how we handle account details, order information, payment-related information, saved readings, journal content, voice-to-text transcripts, app data and other personal information.
17. Australian Consumer Law and limitation of liability
Australian Consumer Law applies.
Our products and Services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with the Services, you may be entitled to cancel your service contract and receive a refund for the unused portion or compensation for its reduced value.
For major failures with physical products, you may be entitled to a replacement, repair, refund or other remedy required by law.
To the maximum extent permitted by law:
· we are not liable for indirect, incidental, special or consequential loss;
· we are not responsible for decisions you make based on tarot content, app prompts, automated outputs, readings, reflections or journal content;
· we are not liable for loss caused by your failure to keep account details secure, provide accurate information or back up content you wish to keep; and
· subject to your rights under the Australian Consumer Law, our liability is limited to the amount you paid us for the relevant products or Services.
18. Indemnity
You agree to indemnify Aquillian Tarot against claims, losses, liabilities, damages, costs or expenses arising from:
· your use or misuse of the Services;
· your breach of these Terms;
· your content;
· your infringement of another person’s rights; or
· your unlawful, harmful or negligent conduct.
This indemnity does not limit any rights you have under the Australian Consumer Law or any other rights that cannot legally be excluded.
19. Termination and account closure
We may suspend or terminate your access if:
· you breach these Terms;
· we need to protect the Services, users, systems or our legal rights;
· required for security, operational or legal reasons; or
· we discontinue the relevant Services.
You may stop using the Services at any time.
Upon termination or closure of your account:
· your access to saved readings, journal entries, voice-to-text transcripts and other account content may cease immediately;
· we may permanently delete account content from our systems in accordance with our Privacy Policy;
· we may retain certain information where required or permitted by law, such as tax, accounting, fraud prevention, dispute resolution or legal records; and
· you are responsible for exporting or saving any content you want to keep before closing your account, where export features are available.
20. Changes to the Services
We may modify, update, improve, suspend or discontinue the Services, including features, pricing, availability and content.
Where required by law or where a change materially affects your rights, we will provide reasonable notice.
21. Changes to these Terms
We may update these Terms from time to time.
Updates will be published on our website or app. The updated Terms will apply from the date stated in the updated version, unless otherwise required by law.
Your continued use of the Services after the updated Terms are published means you accept the updated Terms.
22. Governing law
These Terms are governed by the laws of New South Wales, Australia.
You agree that the courts of New South Wales, Australia, and any courts entitled to hear appeals from those courts, have non-exclusive jurisdiction in relation to any dispute arising from these Terms or the Services.
